Welcome to MARKET, the online marketplace operated by EARTH WEAVERS. These Terms of Service ("Terms") govern your use of our non-profit marketplace platform where artisans, makers, and creators can sell handmade, sustainable, and regenerative goods.

By accessing or using MARKET, you agree to be bound by these Terms. If you do not agree, please do not use our marketplace.

1. Definitions

"Platform" — the MARKET marketplace website and services
"Seller" — any individual or entity listing items for sale on the Platform
"Buyer" — any individual purchasing items through the Platform
"Listing" — any product or service posted for sale on the Platform
"We," "Us," or "EARTH WEAVERS" — the forening operating the Platform

2. Platform Purpose & Values

MARKET exists to support regenerative economies, handmade craft, and community-based production. We prioritise:

Sustainable and ethical production methods
Natural materials and traditional craft techniques
Fair compensation for makers and artisans
Transparency in production and sourcing
Community building and knowledge sharing

3. Account Registration

3.1 Eligibility You must be at least 18 years old to create an account and use the Platform. By registering, you confirm that you meet this requirement.

3.2 Account Information You agree to provide accurate, current, and complete information during registration and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials.

3.3 Account Security You are responsible for all activities that occur under your account. Notify us immediately of any unauthorised use.

4. Seller Obligations

4.1 Listing Requirements Sellers must:

Provide accurate descriptions, images, and pricing for all Listings
Only sell items that align with Platform values (handmade, sustainable, local, ethical)
Disclose materials, production methods, and any relevant product information
Honor stated shipping times and policies
Comply with all applicable laws and regulations

4.2 Prohibited Items Sellers may not list:

Mass-produced or factory-made items
Items made with unethical labour practices
Counterfeit, illegal, or hazardous products
Items that violate intellectual property rights
Products inconsistent with our regenerative values

4.3 Fulfilment & Customer Service Sellers are solely responsible for fulfilling orders, handling customer inquiries, processing returns, and resolving disputes with Buyers. EARTH WEAVERS is not responsible for Seller fulfilment or customer service.

5. Buyer Responsibilities

5.1 Purchase Obligations By placing an order, you agree to pay the listed price plus any applicable shipping costs and taxes. All sales are binding once payment is confirmed.

5.2 Product Understanding Handmade items may have natural variations. Buyers acknowledge that slight differences from photos are inherent to handmade goods and do not constitute defects.

5.3 Communication Buyers agree to communicate respectfully with Sellers and resolve issues directly with the Seller before escalating to Platform support.

6. Payments & Fees

6.1 Payment Processing Payments are processed through Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's terms and conditions.

6.2 Platform Fees EARTH WEAVERS charges a membership fee of 250 DKK / month to support marketplace operations and community programmes. A 2% platform fee is added to each purchase at checkout to cover payment processing costs.

6.3 Refunds & Returns Each Seller sets their own return and refund policy. EARTH WEAVERS does not process refunds directly but may mediate disputes.

7. Intellectual Property

7.1 Seller Content Sellers retain ownership of their product images, descriptions, and designs. By listing on the Platform, Sellers grant EARTH WEAVERS a non-exclusive licence to display, promote, and market their Listings.

7.2 Platform Content The MARKET platform, including its design, features, and branding, is owned by EARTH WEAVERS. Users may not reproduce, distribute, or create derivative works without permission.

7.3 Infringement Claims If you believe content on the Platform infringes your intellectual property rights, contact us at market@earthweavers.dk with detailed information about the alleged infringement.

8. Privacy & Data

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

Sellers and Buyers agree not to use contact information obtained through the Platform for purposes other than completing transactions and providing customer service.

9. Prohibited Conduct

Users may not:

Engage in fraudulent, deceptive, or misleading practices
Harass, threaten, or abuse other users
Manipulate prices, reviews, or ratings
Circumvent Platform fees or payment systems
Scrape, copy, or collect Platform data without permission
Interfere with Platform functionality or security
Violate any applicable laws or regulations

10. Dispute Resolution

10.1 Buyer-Seller Disputes Buyers and Sellers are encouraged to resolve disputes directly. If a resolution cannot be reached, either party may contact EARTH WEAVERS for mediation. Our decision in disputes is final but non-binding.

10.2 Platform Disputes Any disputes between users and EARTH WEAVERS regarding the Platform shall be governed by Danish law and resolved in courts located in Denmark.

11. Termination

11.1 Account Suspension EARTH WEAVERS reserves the right to suspend or terminate accounts that violate these Terms, engage in prohibited conduct, or harm the Platform community.

11.2 User Termination You may close your account at any time by contacting us. Upon termination, you remain responsible for any outstanding obligations, including unfulfilled orders.

11.3 Effect of Termination Upon termination, your right to use the Platform ceases immediately. Provisions regarding intellectual property, liability, and dispute resolution survive termination.

12. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind. EARTH WEAVERS does not guarantee that the Platform will be uninterrupted, secure, or error-free.

EARTH WEAVERS does not guarantee the quality, safety, or legality of items listed by Sellers. We are not responsible for Seller conduct, product quality, or transaction outcomes.

13. Limitation of Liability

To the maximum extent permitted by law, EARTH WEAVERS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability for any claim related to the Platform shall not exceed the fees paid by you to EARTH WEAVERS in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless EARTH WEAVERS, its officers, directors, and members from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your Listings, or your violation of these Terms.

15. Changes to Terms

EARTH WEAVERS reserves the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

16. Community Values & Regenerative Practices

MARKET is built on principles of care, reciprocity, and regeneration. We encourage:

Sliding scale pricing and accessibility options
Transparent communication about materials and processes
Collaboration and knowledge-sharing among makers
Fair pricing that values artisan labour and sustainable practices
Community care and mutual support

While these values are encouraged, they are not legally enforceable obligations. However, EARTH WEAVERS reserves the right to prioritise and promote Sellers who embody these principles.

17. General Provisions

17.1 Governing Law These Terms are governed by the laws of Denmark, without regard to conflict of law principles.

17.2 Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3 Entire Agreement These Terms, together with our Privacy Policy, constitute the entire agreement between you and EARTH WEAVERS regarding use of the Platform.

17.4 Waiver No waiver of any provision of these Terms shall be deemed a continuing waiver or waiver of any other provision.
